The roles we undertake
- Administrator
- This is a court driven procedure that can help companies in many ways. This is useful where there are cash flow issues but a core business that can be preserved. The process protects companies from any actions taken by creditors. This can be used as a pre cursor to a voluntary arrangement to afford protection to the company during the period when proposals are being put to creditors. If there is the need to quickly sell on parts or all of the business then this process can be used providing there is sufficient interest in the business and a fair price is being paid by the purchaser. Creditors or directors can place the company into Administration via many various methods. The processes are fairly complex and need to fit each individual circumstance so for more detailed information please contact us.
- Receiver
- The process is driven by a secured creditor who has a floating charge over the company’s assets. If the company fails to abide by the terms of the charge then the charge holder has the right to appoint an Administrative Receiver to take control of its assets and sell the assets to repay some or all of the money due to the floating charge holder.
- Liquidator
- A liquidator’s powers are wide and varied and include powers to sell the company’s assets, to bring and defend legal proceedings and to pay dividends to the company’s creditors
- Supervisor
- A licensed insolvency practitioner appointed to monitor and supervise the implementation of a company voluntary arrangement (CVA) or an individual voluntary arrangement (IVA).
- Nominee
- A licensed insolvency practitioner appointed to report on the proposal of a company or individual prior to a voluntary arrangement – that is a CVA or an IVA (see Supervisor).
- Trustee
- A licensed insolvency practitioner appointed to administer the estate of a bankrupt.
- LPA Receiver
- Law of Property Act (LPA) receiver does not have to be a licensed insolvency practitioner but is appointed by someone who holds a fixed charge over a property. The organisation that holds the fixed charge is governed by the Law of Property Act rather than the Insolvency Act.
